Terms of Service and Licence (EULA)

Last updated: 6 November 2026

These terms are an agreement between you and Marcin Nykiel ("we", "us"), the publisher of LotusOrb. They are also the game's end user licence agreement (EULA). By accepting them or by playing, you agree to them; if you do not, do not use the game. If you are not of age, a parent or guardian must accept them for you.

1. Licence

We give you a limited, non-exclusive, non-transferable, revocable licence to install and play the game on devices you own or control, for your own non-commercial use. The game, its code, graphics, sounds, music, levels and name belong to us or our licensors and all rights not expressly given are reserved. Playing gives you no ownership and no privileges beyond this licence: your progress, virtual items, nickname, maps and other data in the game are not your property. The terms of the store you got the game from (Google Play, the Apple App Store, the Steam Subscriber Agreement) apply as well.

2. What you must not do

Cheat or use bots, scripts, hacks or modified versions of the game; decompile, disassemble or otherwise reverse engineer it, except as far as the law expressly allows; get around its protections (for example by changing the device clock to open chests); exploit bugs instead of reporting them; overload, attack or try to gain unauthorised access to the game's servers or other players' accounts; copy, sell, rent or distribute the game or its parts; impersonate other people; use the game against the law.

3. Gems, skins and other virtual items

Gems, skins, avatars, chests and other virtual items are part of the licence, not property. They cannot be bought for real money, exchanged, transferred or paid out and have no value outside the game. What a chest gives is random. Items, their prices and rewards may change or be reset in updates, especially after cheating or a bug.

4. Nickname, avatar and account

LotusOrb is for players of all ages. Creating a player account and giving an e-mail address are open to people aged 13 or over. Children under 13 may use the online features and create a player account only with the consent and under the supervision of a parent or legal guardian.

Your nickname must not be offensive, vulgar, hateful, misleading or someone else's name or brand, and should not contain your real name or contact details. You choose your nickname once and cannot change it in the game later; to have a mistake in it corrected, write to us. We may change or block a nickname breaking this. With an online account, you are responsible for what is done with it and for keeping your sign-in safe; one person, one account.

5. Maps and levels you create (the editor)

The editor and everything maps are built from – tiles, traps, obstacles, triggers, art, sounds and effects – and the map format belong to us, like the whole game. A map is an arrangement of those elements and works only in the game; making maps gives you no rights, ownership or privileges in the game or its elements.

You may use your maps only in the game and under these terms. Without our written consent you may not sell them, share them outside the game for profit or use them in other games or products.

A map you have not published stays with you, and this licence does not cover it. The moment you publish a level, you give us a free, non-exclusive, worldwide licence to use that level and any part of it to run, publish and promote the game, commercially as well, in these fields of use (we may pass it on only to those who help us do so, such as publishers, stores and service providers): recording and copying it by any technique, digital included; storing it in the memory of computers, servers and mobile devices; making it available to the public so that anyone can reach it at a place and time of their choosing – in the game, its updates, later versions and editions, on websites and in app stores; displaying, playing and broadcasting it in public; putting it on the market as part of the game, its add-ons or later editions; and using it to promote and advertise the game (screenshots, trailers, videos, social media).

You also permit us to make derivative works of a published level: to change, shorten, fix and combine it with other maps, adapt it technically (formats, previews, thumbnails) and include it, whole or in part, in the official campaign, the tower or other modes of the game, and to let those helping us with the game do so. Your moral rights stay yours: the game shows your nickname with your published level, and if we put your level or a large part of it into official content, we name you there where the game has room for it, unless you ask us not to. In short promotional material where this is not practical, we may leave it out. You agree that the changes described here do not need your approval each time; if a change seriously misrepresents your work, write to us and we will put it right.

The licence is given for 5 years and then continues for an indefinite period (Art. 68 of the Polish Act on Copyright and Related Rights). As far as the law allows, it does not end when you delete the map. A published level you delete, or that belongs to an account you delete, leaves the game's lists and our server; only maps we have already put into the game's official content, and promotional material already made, may stay. No fee is due for the map or for our use of it, unless a separate agreement (such as contest rules) says otherwise.

By creating, publishing or sharing a map you confirm that it is your own work, that you have all the rights needed for everything in it – its title and its music from Newgrounds – that you use the music under its author's licence and the service's terms, that you made the map with a song file you downloaded from Newgrounds yourself, and that the map does not infringe anyone's copyright, trade marks, personal rights or privacy. You alone are responsible for the maps you publish. With a published map our server keeps only the map itself and its details – its layout, title, times, the song's ID and the fingerprint of its file – never the music.

Music in maps: you download songs from Newgrounds or any other source yourself, only for your own private, non-commercial use. LotusOrb does not store, host or share any music belonging to others.

By publishing a map with a song you also confirm that at least one of these is true: the song is free of copyright (public domain or royalty-free); you have a licence or the author's permission to use it in a video game; or the song's licence (for example a Creative Commons licence chosen by its author on Newgrounds) expressly allows its use in games and content made by players. Checking this is your responsibility alone.

When we receive a valid notice that a song in a map infringes copyright, we may hide or remove that map, together with the song's ID and the fingerprint of its file.

Maps and their titles must not contain: anything illegal; vulgar, sexual, hateful or discriminatory content; threats, harassment or bullying; other people's personal data; advertising or spam; anything made to break the game or harm devices.

6. Moderation

We may, but do not have to, review content published by players. We may hide or remove any content and limit or suspend sharing or an account when the content or behaviour breaks the law or these terms, without notice where needed. When we do, we tell the person concerned the reason, on the level's page or by e-mail, as the EU Digital Services Act requires, and they can ask us to review the decision by writing to LotusOrbApp@gmail.com; a person, not a machine, looks at such a request.

How it works: titles and nicknames are checked automatically for forbidden words before they are accepted. A level reported by 10 players within 7 days is hidden automatically and a moderator is told; it stays hidden until a moderator has looked at it and decided. Older reports stop counting. Every other decision – hiding or restoring a level, banning an account or lifting a ban – is made by a moderator or by us, never automatically. Every player can report a level and block an author, whose levels then stop showing. A level's difficulty and points come from the ratings of players who beat it, and start over when a new version is published. Featured and recommendations are our free choice: no level has a right to them, and they may change or be taken away, for example when a level changes.

7. Reporting illegal content and copyright (takedown)

If you see content in the game that breaks the law or your rights – for example a song used without permission – report it to LotusOrbApp@gmail.com (or, for a published level, with the Report button on its page). Give: what the content is (the level's title and ID, or the player's nickname or avatar), why it is illegal or infringes your rights, your name and contact details, and a statement that the report is accurate and made in good faith; for copyright, that you own the rights or act for the owner.

We act on valid reports without undue delay and remove or block the content. If you gave contact details, we tell you what we decided. Its author is told and can reply with a counter-notice if they believe it was removed by mistake. Players who repeatedly infringe lose the ability to share content and may lose their account. Knowingly false reports are not allowed.

8. Other players and third-party services

Content created and shared by players is their authors' responsibility: we do not check it in advance, do not take it as our own and are not responsible for it or for other players' behaviour (this does not change the licence in section 5). We act on it once we learn of it, as described above.

Songs come from the outside service Newgrounds.com, which accepts, checks and moderates them itself, under the terms their authors set there. The game neither hosts nor downloads them: each player downloads a song on its page and uses it on their own device for their own use, under its author's licence and Newgrounds' terms. The game only links to a song's page, as Newgrounds' Terms of Use allow ("Newgrounds permits you to link to pages on the Website", section V.G, newgrounds.com/wiki/help-information/terms-of-use). Newgrounds itself grants no right to use songs in games: that right can come only from the licence each song's author sets on its page. We do not check their content or the rights in them and are not responsible for them; report a song first to that service.

Newgrounds, YouTube, Epic Games, the stores and other services the game connects to or links to are run by others under their own terms. We are not responsible for their content, availability or changes.

9. The game is provided as it is

We do our best for the game to work well, but it is provided "as is" and "as available". As far as the law allows, we give no promise that it will be free of errors, work without interruption, run on every device, or that progress, maps or other data will never be lost. Keep copies of the maps that matter to you (Settings → Your data → Save a copy).

10. Limitation of liability

As far as the law allows, we are not liable for: loss of progress, maps, virtual items or other data; indirect or consequential damage and lost profits; damage caused by other players, their content or behaviour; damage caused by third-party services, devices, internet connections or server outages; and the use of the game against these terms. Where liability cannot be excluded, it is limited to the amount you paid for the game.

Nothing in these terms excludes or limits liability that cannot be excluded by law – in particular for damage caused intentionally or by gross negligence, or for injury to life or health – nor your statutory rights as a consumer, including your rights where digital content does not conform to the contract.

11. Your responsibility

If someone makes a claim against us because of content you published or because you broke these terms or the law, you will cover the damage and reasonable costs this causes us, as far as the law allows.

12. Ending

You can stop playing at any time and delete your data by uninstalling the game (an online account in the game: Profile > My account > Delete account). We may suspend or end your use of the game or of its online parts if you seriously or repeatedly break these terms. The sections on maps you published, liability and disputes stay in force afterwards.

13. Changes to the game and to these terms

Updates may add, change or remove parts of the game. When these terms change, the date above changes and the game asks you to accept the new version; if you do not accept it, stop using the game.

14. Law and disputes

These terms are governed by Polish law. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may take a dispute to the courts there. Please write to us first – most problems can be solved quickly.

15. Apple App Store

If you got the game from the App Store: these terms are between you and us, not Apple; we, not Apple, are responsible for the game, its maintenance and support, and for any claims about it (including product liability, legal compliance and intellectual property claims). If the game fails to conform to a warranty, you may tell Apple, which will refund any price paid; Apple has no other warranty obligation. You confirm you are not in a country under a U.S. embargo and are not on a U.S. list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

16. Final provisions

If any part of these terms is found invalid, the rest stays in force. Not enforcing a part is not giving it up. We may transfer these terms to whoever takes over the game. These terms and the privacy policy are the whole agreement about the game.
